Tabcorp Pays Over $1.9M After ACMA Uncovers Widespread Breaches
Tabcorp fined for violating telemarketing and spam laws.
1Tabcorp's Violations
Tabcorp was found to have breached telemarketing and spam laws following investigations by the Australian Communications and Media Authority (ACMA). The company ignored customer preferences by calling during prohibited hours and contacting numbers on the Do Not Call Register without consent.
2Call Violations
According to ACMA's report, Tabcorp made 351 unauthorized calls to numbers on the Do Not Call Register. Additionally, 82 calls were made outside permitted hours, and nearly 4,000 calls failed to properly identify the caller or the purpose of the call.
3Email and SMS Breaches
Tabcorp sent over 217,000 marketing emails and SMS messages to customers who had unsubscribed within 16 days. These breaches revealed issues with the company's electronic marketing systems.
4Fines and Penalties
ACMA fined Tabcorp $1.254 million for Spam Act violations and $1.504 million for telecommunications breaches, totaling over $2.75 million in penalties.
5Past Violations
This incident reminded of Tabcorp's previous breaches. In June 2025, the company paid over $4 million for sending unlawful marketing messages to members of its TAB X VIP program.
6Future Measures
As part of its agreement with ACMA, Tabcorp will have its VIP marketing processes reviewed by an independent consultant. This review aims to improve the company's governance, systems, and compliance processes.
