1Supreme Court Immunity Ruling

The Spanish Supreme Court has denied requests from the PSOE, Renfe, and constructor Manuel Contreras to sue Victor de Aldama for defamation. Aldama, a convicted businessman in the mask corruption case, made numerous unproven accusations during his defense. The court ruled that his right to defense currently supersedes the plaintiffs' honor rights.

2Judicial Procedural Constraints

Magistrates argued that opening parallel legal proceedings for slander while the main investigation was ongoing would create unacceptable procedural dysfunctions. The court emphasized that such protections apply only when accusations are not manifestly false and are intended to support the defendant's case. Consequently, the businessman remains shielded from these specific criminal actions.

3Collaboration and Sentence Reduction

Aldama, who confessed to paying five million euros in commissions, avoided a four-year prison sentence through a cooperation agreement with the Anti-Corruption Prosecutor's Office. While he accused high-ranking officials, including former minister Jose Luis Abalos, his testimony was treated as a defense strategy, allowing him to remain free despite his convictions.

4Contested Claims Against Officials

During the mask case trial, Aldama leveled severe accusations against various figures, including President Pedro Sanchez, labeling him the leader of a corruption network. Prosecutor Alejandro Luzon largely overlooked these claims, viewing them as a form of venting by the defendant rather than evidence-backed testimony, despite the gravity of the public allegations.

5The Bolaños Defamation Trial

While the Supreme Court blocked most lawsuits, one specific case will proceed to trial on February 17. Minister Felix Bolaños sued Aldama after the businessman claimed on television that Bolaños attempted to bribe him for silence in October 2024. Aldama has yet to provide solid evidence to support this specific bribery allegation.

6Lack of Evidentiary Support

Aldama’s claims regarding the alleged bribery attempt evolved over time, eventually involving a purported spokesperson named Ramon Bermejo. Despite Bermejo providing phone logs, the records showed no relevant connection to the minister. Bolaños has categorically denied any personal relationship or communication with either Aldama or Bermejo, maintaining his innocence throughout the process.

7Defense Strategy vs Truth

The legal tension highlights the conflict between a defendant's right to present a robust defense and the protection of individuals' reputations. The court maintains that as long as the accusations are framed within the context of a defense strategy, they remain protected, even if they lack concrete proof or involve serious public figures.

8Implications for Future Litigation

The upcoming February trial marks the first time Aldama’s public statements against the government will be scrutinized in a court of law. This case serves as a critical test for the limits of judicial immunity regarding testimony. Observers are watching to see if the court finds evidence of defamation in this specific instance.
