UN Inquiry Finds Systematic Age-Based Persecution of Palestinian Children
Commission report details intentional violence against minors in Gaza and West Bank territories.
1Commission Findings on Persecution
The Independent International Commission of Inquiry concluded that Israeli forces engaged in age-based persecution of Palestinian children. The report, dated 14 October 2026, asserts that harm inflicted is not incidental but part of a deliberate pattern. This finding extends previous assessments regarding Gaza to include the occupied West Bank territories.
2Documented Lethal Incidents
The inquiry detailed specific cases, including a seven-month-old baby shot in the head in Hebron and a 14-year-old boy killed near Jenin. In Tammun, a family of six was shot, resulting in the deaths of parents and two sons. These events highlight the severity of force used against minors.
3Escalation of Military Force
Violence patterns have shifted significantly in the West Bank. While air strikes killed six Palestinians between 2008 and October 2023, the number rose to 254 between October 2023 and September 2026. Satellite analysis of a 17 October 2025 car strike contradicted military accounts regarding the vehicle's location relative to designated lines.
4Casualty Statistics and Scope
As of 30 September 2026, the total death toll in occupied Palestinian territories exceeded 75,000, with at least 21,500 children included. In the West Bank alone, 1,080 Palestinians were killed, including 237 boys and seven girls. Since the October 2025 ceasefire, Gaza has recorded at least 300 additional child fatalities.
5Absence of Judicial Accountability
The commission reported no effective Israeli investigations or disciplinary actions regarding the examined cases. Even in four instances where authorities acknowledged errors, families received no remedy. This systemic lack of accountability has entrenched discriminatory practices, according to the report, which noted Israel's continued refusal to cooperate with the inquiry.
6Palestinian Authority Conduct
The report also scrutinized the Palestinian Authority, identifying instances of excessive force. In December 2024, security forces harmed a 15-year-old, violating the Convention on the Rights of the Child. The Authority previously accepted responsibility for a boy's death caused by a security vehicle incident occurring in October 2023.
7Legal Definition of Age
Human Rights Watch advocates for explicitly including age as a ground for persecution in international law. They cite the International Criminal Court's charges against Joseph Kony as a precedent. Sixteen nations currently support adding age to the draft definition of crimes against humanity, with negotiations expected to commence by 2028.
8Enforcement and Justice Barriers
Nasir Qadri, a scholar at Koç University, identifies enforcement rather than jurisdiction as the primary obstacle to justice. The commission recommends that Israel end impunity through independent prosecutions and dismantle practices exposing children to harm. These conclusions serve as a formal inquiry finding rather than a binding court judgment.
