Bombay High Court Blocks Maharashtra Land Acquisition for Wellness Project
Court quashes state government move to seize Tata Power land for private Ayurvedic center.
1Court Overturns Land Acquisition
The Bombay High Court has officially quashed notifications issued by the Maharashtra government to acquire 84 hectares of land from Tata Power. Justices Manish Pitale and Shreeram V Shirsat ruled against the state's attempt to seize the property in Pune. This decision halts the transfer of land intended for a private wellness project.
2Strategic Importance of Site
The disputed 84 hectares serve as the vital catchment area for Tata Power’s 75-megawatt Bhivpuri Hydro Station. Furthermore, the land is essential for a proposed 1,000-megawatt Bhivpuri Pumped Storage Project. The company argued that losing this territory would directly compromise its ability to maintain and expand critical regional hydroelectric power generation capabilities.
3Origins of the Dispute
In June 2018, then-Chief Minister Devendra Fadnavis proposed utilizing part of the land for Vedic chanting activities. The state government later sought to transfer the site to the Maharishi Vedoddharak Foundation. This project, valued at Rs 1,500 crores, was planned to include an Ayurvedic college and a specialized wellness center facility.
4Government Reclassification Attempt
In March 2025, the Bharatiya Janata Party issued a formal notification categorizing the land near the Thokarwadi Dam and Reservoir as an industrial area. This administrative reclassification was a prerequisite for the state to acquire the property. Tata Power challenged this move, citing the land’s original purpose for public hydroelectric utility.
5Legal Basis of Challenge
Tata Power contended that the land was granted to its predecessors over a century ago specifically for public electricity generation. The company argued that the government’s acquisition process violated the 2013 Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, favoring a private entity over established public infrastructure.
6Conflict of Interest Concerns
The legal challenge highlighted the tension between state-led development projects and existing industrial utility rights. By attempting to transfer the catchment area to a private foundation, the government faced accusations of bypassing standard acquisition protocols. The court’s intervention underscores the necessity of adhering to strict legal frameworks when repurposing industrial land.
7Impact on Energy Infrastructure
The court's ruling protects the integrity of the Bhivpuri site, which is crucial for Maharashtra's energy grid. Had the acquisition proceeded, the 1,000-megawatt pumped storage project would have faced significant operational risks. This decision reinforces the legal protections afforded to companies operating essential public utilities against arbitrary state-led land seizures.
8Broader Judicial Precedent
This case serves as a significant precedent for how state governments manage land acquisition under the 2013 Act. By prioritizing the existing public purpose of hydroelectricity over a private wellness initiative, the court has clarified the limits of state power. Future land transfers will likely require more rigorous justification regarding public interest.
