1Antitrust Litigation Discovery Phase

In March 2024, the Department of Justice and 15 states sued Apple for allegedly restricting competition and limiting interoperability. This legal battle has now entered the discovery phase, where both sides exchange evidence. Apple and the government are issuing subpoenas to various tech companies to support their respective legal arguments.

2Broad Scope of Subpoenas

Apple has subpoenaed companies including Epic Games, Samsung, Meta, Oura, and Garmin to refute the government's claims. Simultaneously, the DOJ has targeted firms like Roblox and Snap to gather evidence regarding Apple's App Store policies. These requests seek internal documents, executive communications, and strategic financial data from numerous industry players.

3Epic Games Resistance Strategy

Epic Games is challenging Apple's demand for documents from three previous lawsuits and extensive searches of senior executive files. The company argues these requests are disproportionately burdensome. However, Epic has offered to provide specific data, including Fortnite revenue figures, contracts with Google and Samsung, and records regarding Apple's Core Technology Fee.

4Samsung Executive Document Disputes

Samsung has already processed nearly 900,000 documents for the case. Despite this, Apple is pushing to expand searches to six additional executives, including former and current CEOs. A major point of contention remains whether Samsung Electronics America must produce documents held by its parent company located in South Korea.

5Oura and Garmin Objections

Oura is resisting Apple's requests, specifically questioning whether Apple should reimburse costs for reviewing over 32,000 documents. The company also seeks to withhold information it classifies as trade secrets. Garmin has raised similar objections, refusing to hand over confidential financial and strategic information that could harm its competitive market position.

6Roblox and Playco Challenges

Roblox is currently disputing government requests for information regarding its relationship with Apple and App Store policy applications. Meanwhile, Japan-based Playco is resisting Apple's demands for documents related to lobbying activities. Playco argues that producing these materials would violate its First Amendment rights, citing a previous legal precedent involving Match Group.

7Negotiation Deadlines and Impasse

Several companies involved in these disputes have requested until November 11 to continue negotiations. This extension aims to resolve disagreements over document production scope before the issues are formally declared at an impasse. If these talks fail, the court will likely need to intervene to settle the discovery process requirements.

8Broader Legal Context

This discovery conflict occurs alongside a separate dispute where Apple is seeking documents from 14 federal agencies. Although a special master has ruled in Apple's favor twice, the order is currently on hold pending a government appeal. These overlapping legal challenges highlight the extreme complexity of the ongoing antitrust litigation.
