1Arrest Warrant Issued

Minister Og Fernandes of the Superior Tribunal de Justiça ordered the immediate arrest of judge Sandra Inês Rusciolelli. The decision follows her conviction to 14 years and 20 days in prison for passive corruption and money laundering. Her son, Vasco Rusciolelli, who was also convicted in the same criminal action, is included.

2Flight to Portugal

The arrest order was prompted by a request from the Federal Public Ministry after reports confirmed the judge left Brazil for Lisbon on September 21. Prosecutors argued this departure indicates a clear intention to evade the application of criminal law, especially after she provided a false residential address to the judicial authorities.

3Operation Faroeste Context

The convictions stem from Operation Faroeste, a major investigation by the Federal Police into a scheme involving the sale of judicial decisions. The operation uncovered a network where businessmen paid bribes to magistrates, facilitated by lawyers, to secure favorable rulings for the irregular appropriation of land in western Bahia state.

4Failed Plea Agreement

Sandra Rusciolelli was the first judge in Brazil to sign a plea bargain, which was validated in June 2021. However, in November 2024, Minister Og Fernandes canceled the agreement. The court accepted arguments that the defendants stopped cooperating, missed mandatory hearings, and failed to pay the required fines stipulated in the deal.

5Financial Corruption Scale

According to the Federal Public Ministry, the mother and son negotiated bribes totaling 4 million reais. Investigations confirmed they effectively received 2.4 million reais. A police report specifically highlighted that Vasco Rusciolelli received at least 250,000 reais to ensure his mother issued a favorable decision for a private company involved in land disputes.

6Defense Arguments

During the trial, the Public Defender's Office argued that the defense lacked access to critical evidence presented by the police and prosecutors. The defense claimed that elements of the plea agreements were used against the defendants while other collaborators received benefits, rendering a fair technical defense impossible under the current judicial proceedings.

7Previous Judicial Measures

Before the current arrest order, the STJ had already removed eight judges from the TJ-BA in February 2021. Sandra Rusciolelli had previously been under house arrest and was required to wear an electronic ankle monitor. These restrictions were part of the ongoing judicial oversight following the initial phases of the Faroeste investigation.

8Broader Institutional Impact

The case highlights the deep-seated corruption within the Bahia judiciary, involving 12 judges and 15 lawyers mentioned in the original plea deal. The revocation of the plea agreement and the subsequent order for imprisonment underscore the court's hardening stance against judicial actors who fail to comply with their legal cooperation obligations.
