1Legislative Approval Details

The Greek parliament officially passed a new cryptocurrency tax framework on November 5, 2026. This legislation, which integrates into broader financial market regulations, establishes a 10% tax on capital gains and a 15% levy on income from staking, lending, and decentralized finance. These rules officially take effect on January 1, 2027.

2Capital Gains Thresholds

Investors will face a 10% tax on annual net cryptocurrency gains exceeding 500 euros. If gains surpass this threshold, the entire amount becomes taxable rather than just the surplus. Profits generated from selling assets for traditional currency or using them to purchase goods and services are subject to this specific levy.

3Staking and DeFi Taxation

Article 47 of the new law classifies returns from staking, liquidity provision, yield farming, and blockchain validation as interest income. Consequently, these activities are subject to a 15% tax rate. When such income is paid in cryptocurrency, the taxable value is determined by the asset's euro-denominated price at the transaction time.

4Loss Carryforward Provisions

The legislation provides a mechanism for investors to manage net losses. If annual net cryptocurrency losses exceed 500 euros, taxpayers are permitted to carry those losses forward for a period of five years. These accumulated losses can be utilized to offset future cryptocurrency capital gains, providing a degree of fiscal flexibility.

5Voluntary Disclosure Window

Investors are granted a 12-month window to voluntarily disclose previously unreported cryptocurrency gains. Participants who declare these profits and pay the owed taxes within 60 days of filing will be exempt from late-filing penalties and interest. This provision aims to encourage compliance before the new tax regime begins in 2027.

6Ambiguity in Asset Swaps

Uncertainty persists regarding whether crypto-to-crypto swaps trigger capital gains taxes. While the Finance Ministry has suggested these exchanges are not taxable, the parliament’s Scientific Service warned that the current legislative wording could potentially encompass them. Further implementation directives are expected in the coming weeks to clarify these specific audit and transparency rules.

7Inheritance and Exemptions

The new framework clarifies the tax treatment for cryptocurrency holdings received through inheritance, gifts, and parental transfers, utilizing valuation rules based on recognized trading platforms. Additionally, cryptocurrency sales are explicitly exempted from the country’s standard digital transaction tax, distinguishing these assets from other forms of commercial electronic payments within the Greek system.

8Broader European Context

This move aligns Greece with other European nations that maintain individual responsibility for digital asset taxation despite broader European Union regulatory frameworks. With tax rates across Europe ranging from 8% to 30%, the Greek government acknowledges that estimating future revenue remains difficult, as most local investors currently utilize foreign-based cryptocurrency trading platforms.
